YEARBOOK 2023. At the turn of winter and spring each year, the Supreme Court aims to issue its Yearbook as soon as possible in order to summarize its activity of the preceding year. The Yearbook traditionally contains basic information concerning decision-making and other judicial activities of both Criminal Division and Civil and Commercial Division, or various statistics accompanied by graphs. It further entails, inter alia, the list of judges and judges-interns and summarizes the workload of particular sections and departments of the court administration. 30th anniversary of modern existence of the Supreme Court of the Czech Republic

In 2023, the Supreme Court of the Czech Republic commemorated 30 years of its modern existence. The Supreme Court was established on 1 January 1993 after the dissolution of the Czech and Slovak Federative Republic as the successor of the former federal Supreme Court. It relocated from Prague to Brno and on 10 September 1993, after partial reconstruction, the new seat of the Court was opened. Therefore, in September 2023, an international conference titled “The Role of The Supreme Courts in Providing Effective Legal Protection” will take place in Brno. At this occasion, the President of the Court of Justice, Koen Lenaerts, and other prominent figures of the European judiciary have promised to participate. Video:

On the occasion of the Czech Presidency of the Council of the European Union, the Supreme Court of the Czech Republic held the Colloquium of the Network of the Presidents of the Supreme Judicial Courts of the European Union from 13 to 15 October 2022

From 13 to 15 October 2022 Brno became the centre of European justice, as the Supreme Court hosted the Colloquium of the Network of the Presidents of the Supreme Judicial Courts of the European Union. The Colloquium was attended by circa 50 prominent figures of the European judiciary. These were mainly the Presidents or Vice-Presidents of more than 20 European Supreme Courts, together with representatives of the Court of Justice of the EU and several major European judicial institutions. The Colloquium was held in the context of the Czech Presidency of the Council of the European Union.

Declaration of the Network of the Presidents of the Supreme Judicial Courts of the European Union and the European Network of Councils for the Judiciary

The Network of the Presidents of the Supreme Judicial Courts of the European Union and the European Councils for the Judiciary resolutely condemn the severe breach of the international law and aggressive act of war committed by the Russian Federation against the Ukraine. They appeal for a return to civil forms of debate that respect international law, human rights and the principles of democracy and the rule of law. The Networks express their utmost concern for the people of Ukraine and their solidarity with the Ukrainian people and their judiciary. They will, to the extent possible support the Supreme Court of Ukraine, the High Council for Justice and the entire Ukrainian judiciary, in dealing with this most serious crisis. The Network of the Presidents of the Supreme Judicial Courts of the European Union and the European Councils for the Judiciary call on all EU member states and EU institutions to take on all means and resources that the rule of law places at their disposal to end the injustice.

Legal classification of the attempted theft during the state of emergency in the context of the COVID-19 pandemic

The Supreme Court, sitting as the Grand Chamber of the Criminal Division, in its judgment of 16 March 2021 (Ref. No. 15 Tdo 110/2021) addressed the issue concerning legal classification of the attempted theft during the state of emergency. The Grand Chamber had to unify the contrasting views of fourth and sixth chamber of the Criminal Division concerning the conditions for using higher penalty for a theft according to Section 205 (2) and (4) (b) of the Criminal Code. This provision in its paragraph 4 (b) stipulates that the offender shall be punished with higher penalty if the theft is committed during an “event seriously threatening the life or health of people”.
